New Hampshire Republican Sen. Judd Gregg has withdrawn his name from consideration as President Obama’s commerce secretary, a major blow to an administration seeking to put a series of Cabinet problems behind it.

In his written statement, Gregg cited recent developments regarding the economic stimulus package and the decision to have the next census director report directly to senior White House officials as evidence that he and President Obama were too different ideologically for the pairing to work. “This was simply a bridge too far for me,” Gregg said of his decision.

President Obama dictatorial temperament

  • Title 13 of the U.S. Code, Chapter 1, Subchapter I, § 2, entitled “Bureau of the Census,” states: “The Bureau is continued as an agency within, and under the jurisdiction of, the Department of Commerce.”

Not under the jurisdiction of Obama and Rahm Emanuel, but the Department of Commerce. The Director of the Census by law must be within the Department of Commerce and under the direction of the Senate approved Secretary of Commerce who then reports to the president.

A change must be made in the law before the White House can constitutionally alter that arrangement. Admittedly, with a Democrat majority in both Houses, Obama will have things his way. But at the very least, appearing to issue orders not authorized by law (as the Constitution requires) smacks of a hasty if not dictatorial temperament.

According to the Chicago Daily Observer, the Secretary of Commerce will not report directly to Obama, but his designee — feared by Republicans to be Chief of Staff Rahm Emanuel. Last week, Mary Ann Akers of the Washington Post cited a senior Republican Senate aide, who declared that letting the census “be run out of Rahm’s office is like putting PETA in charge of issuing hunting permits.”

Emanuel: I’m Getting Death Threats Over Blagojevich

Obama’s Chief of Staff Refuses to Go to Work Because of Media Stakeout

The President-elect’s chief of staff, Rahm Emanuel, said today he won’t go to the Chicago Presidential transition offices in order to avoid reporters seeking to ask him whether he had contact with Illinois Governor Rod Blagojevich about the Senate seat vacated by Barack Obama’s election.

Emanuel appeared “beet-red,” according to an ABC News cameraman who was invited inside by Emmanuel to use his bathroom this morning.

“I’m getting regular death threats. You’ve put my home address on national television. I’m pissed at the networks. You’ve intruded too much, “ Emanuel said, according to the cameraman.

A spokesman for Emanuel says he later showed up at the office, apparently able to sneak out of the house without being seen by reporters waiting to askhim questions.

Rahm Emanuel’s Replacement: Just A ‘Seat-Warmer’?

rahm-emanuel-1

A host of Chicago politicians are lining up to run for Rahm Emanuel\’s soon-to-be-vacant Congressional seat. But the lucky winner may only have the office for a single term, Greg Hinz reports in Crain\’s Chicago Business.

The reason, Hinz says, is because of talk that Emanuel might only serve as Obama\’s chief of staff for two years and would like to return to his old seat upon leaving the White House:

[T]here’s an intriguing wrinkle in the race for Mr. Emanuel’s seat: talk that he really only wants to serve as chief of staff for two years, and wants a mere seat-warmer who would give the job back when Rahm so requests.

Mr. Emanuel’s spokeswoman terms that talk “false and ridiculous.” But at least one source, who claims to have discussed the possibility with Rahmbo personally, says he really was reluctant to give up the seat and really would like to keep his options open to reclaim it down the road.

If that talk is true, look for municipal finance banker John Borovicka, Mr. Emanuel’s chief of staff, to run for the House and for Mr. Emanuel to cut lots of Chicago-style deals to get it for him. (Mr. Borovicka, who also has never run for anything, says he’s thinking about running but has “no plans” to seek it.)
